XRP advocate Bill Morgan has openly criticized former SEC lead counsel Jorge Tenreiro for omitting his defeat in the Ripple case while celebrating other victories in his new law firm biography. As Morgan points out, Tenreiro boasts of victories over Sam Bankman-Fried, Terraform Labs, and Binance on his profile at Bernstein Litowitz Berger & Grossmann LLP, but is careful not to mention the win over Ripple.


Morgan cited the absence as a recognition by the lawyer that Ripple’s win was more significant than the attorney would like to acknowledge. He added that the SEC had lost two-thirds of the case and even abandoned its appeal, which indicated the power of Ripple’s position.

Ripple Case Strategy Under Fire

Morgan also targeted Tenreiro’s legal strategy, calling his claim that XRP itself represented a security unsustainable. This argument proved counterproductive, as the court determined that XRP was not a security, which was highly detrimental to the SEC’s overall enforcement agenda.


He also recollected what he termed Tenreiro’s effort to defame attorney John Deaton in the process. In the case of Morgan, this method crossed professional boundaries and exhibited the aggressive strategies employed during the trial.


Ripple Secures Final Judgment

Ripple recently secured its most decisive victory as the United States Court of Appeals for the Second Circuit officially closed the SEC case. This concluded over four years of litigation that had commenced in 2020 and was a legal victory for Ripple.


Both parties had stipulated to dismiss their appeals earlier this year, and the court approved the stipulation. Judge Analisa Torres’s ruling will stand, thereby creating a line of difference between institutional sales of XRP and secondary market transactions, which was the main defense used by Ripple.


The settlement also decreased Ripple’s payment obligation and removed the threat of a permanent injunction against the institutional sales of XRP. This offered long-desired regulatory certainty and removed a grey cloud that had been hanging over Ripple and XRP.


Morgan’s criticism highlights how omitting Ripple’s victory shapes the public perception of Tenreiro’s record. For the XRP community, the final ruling remains a defining win that outweighs the SEC lawyer’s other achievements.
