BitMEX lawsuit allegations have resurfaced after a new class action accused the crypto derivatives exchange of manipulating its liquidation system to seize customers’ Bitcoin collateral. The case was filed in the US District Court for the Southern District of New York, as the exchange gets ready to wind up later this year.

BKX Services Inc. and David Namdar allege in the BitMEX lawsuit that they lost 622.66 BTC during forced liquidations. The complaint states that BKX Services claims 305.81 BTC were lost and that Namdar lost more than 316.85 BTC in Bitcoin when its leveraged positions were liquidated.

The plaintiffs claim that BitMEX’s trading platform granted an unfair advantage to the exchange. They claim that an internal trading desk received confidential information about customers and was able to trade even during a platform outage, when normal traders were not able to trade or close their positions. The complaint also alleges that these circumstances enabled BitMEX to enjoy a profit from customer liquidations.

The BitMEX lawsuit seeks the return of the disputed Bitcoin, along with compensatory and punitive damages. The proposed class consists of all United States customers who purchased Bitcoin perpetual swap products on BitMEX on or after July 23, 2018.

The new BitMEX lawsuit comes after the exchange announced that it will shut down after 11 years. BitMEX has declared that it will discontinue operations on September 23 following a strategic review by HDR Global Trading. New account registration is already disabled and starting new trading positions will cease on August 26. BitMEX’s utility token BMEX reportedly lost approximately 90% of its value after the announcement of its closures.
