Former businessman and co-founder of Terraform Labs, Do Kwon is once again facing significant challenges in his extradition to South Korea after Montenegro’s highest prosecutor has disputed the same. 

The Supreme State Prosecutor’s main ground of objection is the jurisdiction of the High Court’s decision, asserting that it may have gone ultra-vires its authority. 

Challenged Extradition Decision

Montenegro’s highest legal authority, the Supreme State Prosecutor, has questioned the High Court’s ruling to extradite Do Kwon to South Korea, arguing that the court may have overstepped its jurisdiction. 

A local report from Montenegro’s Office of the Supreme State Prosecutor has brought out the procedural errors in the extradition process. The report reveals the top prosecutor arguing that the High Court is “going beyond their authority to make a decision on extradition, which is the exclusive right of the Justice Minister.” 

This question of jurisdiction is based on the fact that back in March 2023, Do Kwon was arrested by the Montenegrin authorities during his travel to Dubai, for the alleged use of counterfeit documents. 

This arrest followed the bloody aftermath of Terraform Labs’ collapse in May 2022, which resulted in a staggering $40 billion loss in the crypto market. 

Do Kwon, who faces criminal charges in both the United States and in South Korea, has faced extradition deliberations from the Court of Montenegro since the beginning of his trial. While Han Chang-joon, Kwon’s associate, has already been successfully extradited to South Korea, Kwon’s fate remains uncertain amidst such ongoing appeals.
