Dogecoin trademark deal ends: does the 21Shares ETP keep the name?

Here is what is documented: Dogecoin trades at $0.076655, or €0.068447, at 1:53 p.m. German time on Sunday, October 25, 2026, down 1.2 percent from 24 hours earlier. Also documented: the Dogecoin Foundation has ended its exclusive trademark agreement with House of Doge, the termination has been in force since October 19, and an exit payment of $400,000 is still outstanding. The figures come from a mandatory disclosure that House of Doge filed with the US Securities and Exchange Commission on October 23. Our assessment follows further down: for the price, the matter is small; for anyone holding a Dogecoin security in a brokerage account, it is the more important news of the week.
What ended between the Dogecoin Foundation and House of Doge on October 19
The Dogecoin Foundation administers the Dogecoin word mark and the familiar symbol. It does not issue financial products itself. Anyone who wants to use the name for a product needs a license, and until a week ago House of Doge held that license exclusively.
As of October 19, that arrangement is over. Both sides lifted the agreement by mutual consent. Three things fell away at once: the exclusivity, the right to pass the license on to third parties, and the titles. House of Doge and its Nasdaq-listed parent company may no longer call themselves the Foundation's "Official Corporate Arm" or "Official Commercial Partner". By December 31, 2026, both companies must also change their corporate names.
Since October 21, the Foundation's official commercial partner has been Dogecoin Labs instead, whose launch we reported on October 22. At that point it was still open how the roles would be split between the companies involved. The filing of October 23 answers that question: House of Doge hands the software, the source code, the domains and the infrastructure of the search app to Dogecoin Labs and receives shares worth $4 million in return, calculated on a pre-money valuation of $120 million. Debts and contracts of House of Doge do not move with it. The handover is not complete. It requires the consent of the secured creditors and the release of liens, and either side may withdraw if nothing has closed within 30 days of October 19. That would be November 18.
Three Dogecoin products keep the name, payment services and merchandise do not
A simple, non-exclusive license takes the place of the old contract. It is narrowly drawn and names three 21Shares products specifically. Everything else drops out: payment products, merchandise and the corporate name itself are no longer covered. Every further regulated or tokenized product will need the Foundation's written consent.
| Product | Market | For investors in Europe |
|---|---|---|
| 21Shares Dogecoin ETP | Xetra, gettex, SIX | tradable through any securities account, quoted in euros |
| 21Shares Dogecoin ETF | United States | as a rule not available to retail investors in the EU |
| 21Shares 2x Long Dogecoin ETF | United States | leveraged, likewise not for EU distribution |
Of the three protected products, then, exactly one matters for a European securities account. The 21Shares Dogecoin ETP carries the ISIN CH1431521033 and the German security number A4A5WJ, it has been running since April 8, 2025, and it is quoted in euros on Xetra and on gettex. The issuer's product page reports assets of $9.49 million, spread across 3.72 million shares with a net asset value of $2.55 per share. Custody is physical, at BitGo Europe GmbH.

$400,000 and a cure period of ten trading days
The termination costs money. House of Doge owes the Foundation a negotiated exit payment of $400,000. It falls due as soon as sufficient funds are available, and the company expressly left open in the filing when that will be. Payment may be made in cash, in shares of the parent company, or in a mixture of the two. Only payment in full discharges the license fees and the remaining obligations from the old contract; until then, accrued claims stand.
The sentence that matters for holders of the security sits further back: if the payment fails to arrive, the Foundation can put the new license at risk after a notice and a cure period of ten trading days. The license that secures the name for the three products therefore hangs on a payment whose timing the debtor itself does not name.
The relative size can be calculated. At a total expense ratio of 2.50 percent, the European ETP yields roughly $237,000 in fees a year on assets of $9.49 million. The exit payment of $400,000 thus corresponds to about one year and eight months of fee income from this single product. More comes in from the US funds, but the order of magnitude shows that the dispute is not about pocket money.
From exclusive partner in April 2025 to ordinary Dogecoin licensee
The comparison with the launch is worth making. When 21Shares listed the Dogecoin ETP in Europe on April 8, 2025, the cooperation with House of Doge was expressly marketed as an exclusive partnership. Exclusivity was the selling point: a product with the blessing of those who own the brand. Eighteen months later, the exclusive partnership has become a non-exclusive license that lists three products and permits nothing else.
For the product itself, nothing changes for now. The ETP is physically backed, the coins sit with the custodian, and a trademark dispute does not touch the deposited holdings. What changes is the story around it. Anyone who bought the ETP in 2025 because it was meant to be the official version today holds a product whose naming right is time-limited and tied to an open invoice. The term of the new license ends on October 19, 2029.

The ISIN shows which Dogecoin product sits in your account
For investors in Europe, the situation can be settled in a few minutes. Every position in a securities account comes with an ISIN. If it begins with CH1431521033, the 21Shares Dogecoin ETP is in the account, and with it one of the three securities covered by the new license agreement. If a different identifier is shown, it is a product from another issuer, which this contract does not touch at all.
The second point concerns costs. 2.50 percent a year is a running fee that accrues regardless of the price and is deducted pro rata from the net asset value every day. Buying directly incurs a one-off exchange fee instead, but then you have to keep custody of the coins yourself. Anyone who wants to compare will find the terms in our overview of crypto exchanges and, for custody afterwards, in our comparison of hardware wallets.
The third point is tax, and it is often overlooked. An ETP is a security and falls under the flat-rate withholding tax, no matter how long you hold it. Directly held coins, by contrast, are a different kind of asset under section 23 of the German Income Tax Act, and after a holding period of one year the gain on a sale is tax free. We keep track of where this holding period and the ongoing debate about changing it stand. With a coin quoted 89.5 percent below its record high of May 7, 2021, the difference between the two routes is mainly theoretical at the moment, but it remains the decision that is taken before the purchase.
$538,000 flowed out of the US Dogecoin funds this week
The market has not priced the matter in so far. Dogecoin stands at $0.076655 on Sunday midday, the daily high was $0.077935 and the daily low $0.074965. The price is therefore moving in the same narrow range as the day before, when we wrote about the lowest level in 65 days. Since then the $0.0750 mark has held: the daily low was just below it, but Saturday's close was above. Over seven days the coin is down 3.3 percent, over 30 days down 20.8 percent. Market capitalization stands at $11.99 billion, turnover over the past 24 hours at $513 million. The figures are on CoinGecko's price page.
At the American Dogecoin funds, outflows still dominate. According to SosoValue data summarized by U.Today on October 24, net outflows this week add up to around $538,000. That is the largest weekly outflow since mid-August, when more than $564,000 was withdrawn. Measured against the size of these funds, those are manageable amounts, and that is precisely the point: interest in the regulated wrappers remains small.
One calculation makes it tangible. At $9.49 million in assets and a price of $0.076655, the European ETP holds roughly 123.8 million DOGE. Against a circulating supply of 156.46 billion units, that is 0.0791 percent of all existing coins. Per share, the net asset value of $2.55 corresponds to about 33 DOGE. The regulated route into Europe therefore ties up less than a thousandth of the supply, and a dispute over its name moves the price correspondingly little.
Our assessment: the Dogecoin license hangs on a payment, not on the price
From the newsroom's point of view, the most important sentence in the filing is not the number 400,000 but the cure period of ten trading days. The construction itself argues for that reading: a license that can be revoked if a payment fails to arrive, and whose date the debtor does not name, is a license on call. Against it stands the economic position of both sides. The Foundation has no interest in detaching the name from the only three regulated products that carry it, because they are its most visible link to the traditional financial markets. And for a listed company, $400,000 is a sum that can be settled in its own shares if need be, which the contract expressly allows.
More likely than a withdrawal of the name, therefore, is that the payment arrives and the matter ends in December with the change of corporate name. What remains is a shift in the balance of power: the Foundation has freed itself from an exclusive tie, keeps control over every future product, and has a new partner in Dogecoin Labs, in which the old one merely holds a stake. What is assessed here is the situation, not a decision to buy or sell. Anyone investing in Dogecoin has to reckon with the total loss of the amount committed.
Dogecoin trademark rights: the license runs to October 19, 2029
The Dogecoin brand no longer stands behind a single company, but behind three products named individually and one new partner. For a European securities account that means this: only the ETP with the ISIN CH1431521033 is affected, its naming license runs to October 19, 2029 for now, and it is subject to a payment of $400,000. The next two dates are fixed: November 18 for the completion of the handover to Dogecoin Labs, and December 31, 2026 for the renaming of the two companies. Until then nothing changes in the deposited holdings or in the price, and that is exactly why this matter is one for the securities account and not for the chart.
