Why Kalshi is legal in California
Kalshi is a federally regulated exchange. The CFTC designated it a contract market in 2020, the same status futures exchanges hold.
Kalshi argues that makes its contracts derivatives, which only the CFTC can police. California's own regulators have not acted on that question.
The live challenge comes from tribes, and it is only about tribal land. If you trade anywhere else in the state, nothing has changed.
Legal today is not the same as settled. The Ninth Circuit, which covers California, ruled against Kalshi twice in 2026. Here is what each ruling means.
What you can trade on Kalshi from California
Everything Kalshi lists: sports, politics, economics, crypto, culture and weather. You must be 18 or over and pass its ID checks.
Sports is the big one. Kalshi lists game and season markets across the NFL, NBA, MLB and NHL. The Dodgers, Lakers, Warriors and 49ers all trade here.
Location decides, not your home address. Kalshi now blocks trading on three tribes' lands, its first geofence of its own choosing.
Everywhere else in California, the full menu is open, sports included.
How Kalshi works for California traders
Every Kalshi contract is a yes-or-no question. It pays $1 if the answer is yes and nothing if it is no.
The price is the market's odds. A contract at 60¢ means traders put the chance at about 60%.
Say the Dodgers are 60¢ to win tonight. You buy 100 contracts for $60. Kalshi's standard fee on that trade is $1.68.
If the Dodgers win, you collect $100, a $38.32 profit. If they lose, you are out $61.68.
You trade against other people, not the house. Kalshi earns its fee either way, so it has no stake in who wins.

What California has said about Kalshi
California has not sued Kalshi or ordered it to stop. We found no cease-and-desist letter or regulator notice from the state.
It has taken sides, though. Attorney General Rob Bonta joined 26 other states and DC in a brief backing the tribes' appeal.
The brief argued an exchange should not escape tribal gaming law just by calling a sports wager a contract. The court agreed.
The California tribes' lawsuit against Kalshi, explained
Blue Lake Rancheria and Chicken Ranch Rancheria of Me-Wuk Indians sued Kalshi and Robinhood in federal court in July 2025. Robinhood sells Kalshi's contracts in its app.
The tribes say sports contracts bought on their lands break the Indian Gaming Regulatory Act. A third tribe, Picayune Rancheria of the Chukchansi Indians, sued too but left the appeal.
A federal judge in San Francisco turned them down. She found the trades did not happen on tribal land.
On September 16, 2026, a three-judge Ninth Circuit panel reversed her. It found the tribes likely to win, and no judge dissented.
The reasoning is simple. A trade happens where the user stands, not where Kalshi's servers sit. Buy a contract on a reservation, and the gaming happens there.
The court compared a $100 Giants contract on Kalshi with the same $100 bet on DraftKings. “Kalshi may reshuffle the cards, but it cannot change the hand,” it wrote.
The tribes lost one point. They wanted Kalshi's “legal in all 50 states” ads stopped. The court refused, because the law is still unsettled.
It did not order Kalshi off the land either. It sent the case back for the judge to weigh an injunction. Eight days later, Kalshi told her it had switched off its markets on three tribes' lands.
What could change Kalshi's status in California
Three things could. The first is the state itself. On August 28, 2026, the Ninth Circuit held Nevada's gaming law likely applies to Kalshi's sports contracts.
That ruling binds federal courts in California too. If California chose to act, the path is open. So far it has backed the tribes instead.
The second is the tribal case, now back in the district court. The ruling gives other California tribes a path to the same claim over their own lands.
The third is the Supreme Court. The circuits are split. The Third sided with Kalshi in April. The Sixth ruled against it on September 25.

How Kalshi compares to sports betting in California
Apart from horse racing, betting on sports is not legal in California, in person or online.
Voters had their chance in November 2022. They rejected Proposition 26, for tribal casinos, and Proposition 27, for online apps. Proposition 27 lost with 82% voting no.
So California has no licensed sportsbook to compete with. The fight is between the exchanges and the tribes.
The difference is who supervises the product. A sportsbook would need a state license. Kalshi answers to the CFTC, which is why it can list sports here at all.

Sign up with your email, confirm your identity with a driver's license or passport, and fund the account.
Kalshi takes bank transfers, debit cards, Apple Pay, PayPal, Venmo, wires and crypto, among others.
Withdrawals go back to your bank or card. There is nothing extra to do in California: one account works across the state, except on the three tribes' lands.
