Why Kalshi is legal in Iowa
Kalshi is a federally regulated exchange. The CFTC designated it a contract market in 2020, the same status futures exchanges hold.
Kalshi says that makes its sports contracts derivatives, which only the CFTC can police. Iowa's attorney general calls them sports betting.
No court order or state action stops Kalshi in Iowa today. You can trade every category, sports included.
But legal today is not the same as settled. Kalshi sued Iowa to protect itself, and lost the first round. Here is what that means.
What you can trade on Kalshi from Iowa
Everything Kalshi lists: sports, politics, economics, crypto, culture and weather. You must be 18 or over and pass its ID checks.
Iowa has no major-league team. Its local markets are college games, and the Hawkeyes' October 3 game against Ohio State is already trading.
Politics is busy this fall. Iowa elects a governor and a US senator on November 3, 2026, and Kalshi lists both races.

Kalshi told the court it has nearly 42,000 verified users in Iowa.
How Kalshi works for Iowa traders
Every Kalshi contract is a yes-or-no question. It pays $1 if the answer is yes and nothing if it is no.
The price is the market's odds. A contract at 60¢ means traders put the chance at about 60%.
Say the Hawkeyes are 60¢ to win Saturday. You buy 100 contracts for $60. Kalshi's standard fee on that trade is $1.68.
If Iowa wins, you collect $100, a $38.32 profit. If it loses, you are out $61.68.
You trade against other people, not the house. Even the judge in Kalshi's Iowa case explained it with a Hawkeyes football game.

What Iowa has said about Kalshi
Iowa has not sued Kalshi or ordered it to stop. Its attorney general has made her view plain, though.
On March 4, 2026, Attorney General Brenna Bird met Kalshi's director of state relations. Kalshi expected a talk about a tax bill.
Instead, Kalshi says, her staff asked “pointed questions.” Bird said her office had “been looking at this a long time,” according to Kalshi.
After the September ruling, she went further. “Anyone offering sports betting in Iowa now knows they must play by the same rules,” she said.
The Iowa Racing and Gaming Commission, which licenses sportsbooks, has not acted. The judge noted Kalshi had apparently never dealt with it.
Lawmakers tried a third route. On March 31, 2026, the Iowa Senate voted 45 to 1 to license and tax prediction markets.
Senate File 2470 would have required a state permit and a 20% tax on Iowa revenue. It stalled in the House.
Kalshi's lawsuit against Iowa, explained
Kalshi sued first. On March 11, 2026, it filed KalshiEX LLC v. Bird in federal court in Des Moines, No. 4:26-cv-00109.
It named Bird, the Racing and Gaming Commission and its members. It asked the court to bar Iowa from enforcing its gambling laws against it.
The argument is the one Kalshi makes everywhere. Federal law, it says, gives the CFTC exclusive power over its contracts.
Judge Stephen Locher heard the motion on August 7. On September 8, he denied Kalshi a preliminary injunction.
His reasoning turned on one word. The CFTC's exclusive power covers “swaps,” and he found sports contracts unlikely to be swaps.
Following each state's law, he wrote, “may be inconvenient for Kalshi, but it is not impossible.”
He also noted Kalshi once called itself “the first app for legal sports betting in all 50 states.” It “should have proceeded with greater caution,” he wrote.
The American Gaming Association and a coalition of tribes filed briefs against Kalshi. The coalition includes the Sac & Fox Tribe of the Mississippi in Iowa.
The ruling does not end the case. It means no court order protects Kalshi while the case goes on. That is where the appeal comes in.
Kalshi appealed on September 15. The Eighth Circuit docketed it as No. 26-2874, and Kalshi's opening brief is due November 6, 2026.
What could change Kalshi's status in Iowa
Three things could. The first is Iowa itself. With no injunction in place, the attorney general or the commission is free to act.
The judge pointed to Iowa Code section 725.7, which makes bookmaking outside licensed channels a crime.
Kalshi has warned what enforcement would mean. It says it would have to close Iowa users' open positions before they settle.
The second is the Eighth Circuit. It has never ruled on this question, and its decision would bind Iowa, Minnesota and five other states.
Its district courts already disagree. In July, a Minnesota judge blocked that state's ban, finding Kalshi likely to win. Our page on Kalshi in Minnesota explains why.
The third is the Supreme Court. The circuits are split. The Third sided with Kalshi in April; the Ninth and Sixth ruled against it.

How Kalshi compares to sports betting in Iowa
Sports betting has been legal in Iowa since 2019. Governor Kim Reynolds signed the law on May 13 that year.
The Racing and Gaming Commission licenses it. Bets run through Iowa's casinos, in person or through apps like DraftKings, FanDuel and BetMGM.
The age rules differ. Iowa sportsbooks take bets only from people 21 and over. Kalshi accepts traders at 18.
So does the oversight. A sportsbook answers to Iowa's regulator. Kalshi answers to the CFTC, and that difference is the whole dispute.
DraftKings and FanDuel hold Iowa sportsbook licenses. Their prediction apps do not offer sports contracts in Iowa.
